I’m a bit confused…my tenant hasn’t paid any rent since start of March eviction moratorium. Am I entitled to file for eviction at this time if tenant hasn’t provided me with this declaration?…or…does this mean landlords can file to evict a tenant for ANY OTHER legal reason (providing the tenant hasn’t furnished the declaration), with the only exception for nonpayment of rent through December? I’m also assuming this declaration is applicable for all U.S. 州.
As I understand it, you should go ahead and file for eviction. If the tenant does not file the declaration, they should be evicted. If they do file it, you are out of luck as I understand it.
Even though the declaration stipulates they be paying monthly towards their rent owed-ours didn’t and I tried to argue it but got shot down. Everything is on the 租户 side. 这被滥用了!
